Misdemeanors in the state of Washington generally fall into one of two categories. First, “simple” misdemeanors are crimes where the maximum penalty a court can impose is 90 days in jail and a $1,000 fine. Second, “gross” misdemeanors are crimes where the maximum penalty a court can impose is 365 days in jail and a $5,000 fine. No misdemeanor can have a penalty greater than 365 days in jail and/or a $5,000 fine.
